Can I delay or better yet stop foreclosure? My husband called the Mrtgage Co. and received a conditional modification, then they never received (they said) the certified funds payment. We've placed tracers on them which costs $ and is apparently difficult to do with a bank check. Now we've received another foreclosure notice with a Date sale on 7/22/08. Any help here?

Surely you sent that certified funds payment return receipt requested.
You need a lawyer, yes, I know its expensive, maybe you can find a paralegal. But if you have any chance at all you need to know what you need to do, and how you need to do it. Or you might as well pack.
If they cashed the check its not difficult for the issuing bank to check on it, there isn't any reason at all for them to be having a problem with that. Their records would show funds moving, and believe me, they know where their money is going.

Find all your paperwork and notes, everything. Go to your motgage company and see what they can do. Then go see another bank to see if they'll qualify you for a new mortgage. Even seek a lawyer's advice.
If you're in the military at all, they have something I heard to help you.
Can you get a parent to buy out your mortgage so they get a new mortgage and you pay them?
I wish you luck though. I'm sure it's not easy.

The foreclosure in Florida is Judicial. Basically, they have to take it to court. So time to see a lawyer ASAP.
A lawyer can review the mortgage agreement for possible illegalities and stop foreclosure dead on its track. Possibly advice on other solutions depending on your circumstances. A loss mitigator might be able to help you better on other possible solutions.
You can try mediating with the mortgage but usually if they claim to have missed a payment, they may not stop and go the full yard for the foreclosure.
Now you said there is a sale date. That sounds like it will be going for sheriff sale or auction. You will have to get the ball rolling before the date. Hopefully, they do not find a buyer, but if they do then it will all be over.
